US Senator Wyden calls for WTO action against Chinese solar imports

In the wake of the bankruptcy of three US solar manufacturers in recent weeks, a senior US Senate Democrat is asking President Barack Obama to levy new trade penalties against China, which he argues is illegally subsidizing its solar panel industry.
Senator Ron Wyden, Democrat-Oregon, and the chair of the Senate Finance Subcommittee on Trade, said China was winning the race to create green jobs by essentially dumping cheap solar panels on the US market.
"We need only look at the bankruptcies of major American innovators and producers of solar panels to see the material injury these imports appear to be inflicting on our domestic industry," Wyden wrote in a letter to the White House. "Unless the U.S. takes aggressive action to combat the import surge of Chinese solar panels and the unfair trade practices that China employs, our efforts to facilitate the creation of the new jobs our economy needs will be substantially undermined."

US solar manufacturers Evergreen Solar, SpectraWatt and Solyndra, which declared bankruptcy in August and September, all cited Chinese competition as a factor in their decisions to shutter production.
Wyden said Obama"s administration can take a range of actions to level the playing field against Chinese solar imports, including a Department of Commerce investigation of imposing anti-dumping duties on Chinese solar panels and pursuing a case against China at the World Trade Organization.
"China's subsidization of solar panel production provides the grounds for your Trade Representative to pursue litigation at the World Trade Organization," Wyden wrote, in his letter.
If the White House does not act, Wyden said he would introduce a bill to retaliate against Chinese solar manufacturers.
A spokesman for the Office of US Trade Representative did not immediately respond to a request for comment on Wyden's letter. A spokesman for the US Solar Energy Industries Association also did not respond to a message on Thursday.
A report by GTM Research released August 29, commissioned by SEIA, found the US was actually net exporter of solar products to China in 2010, with a trade surplus of about $240 million. According to that study, the US exported a total of $5.6 billion worth of photovoltaic panels and components, and imported $3.7 billion of PV equipment.
